What is a durable power of attorney?

A durable power of attorney (durable POA) is a legal document that lets you (the principal) appoint another person (your agent) to handle financial and legal matters, with language that keeps that authority in effect if you later lose capacity. That durability clause is what separates it from an ordinary (non-durable) POA, which typically ends at incapacity.

Your agent can only do what the document authorizes: manage accounts, pay bills, deal with property, handle taxes or benefits, or complete other powers you grant. A durable financial POA is not a medical directive and does not authorize health care decisions.

Some states that adopted the Uniform Power of Attorney Act treat a POA as durable unless the document says otherwise. Virginia’s adoption, for example, states that a power of attorney created under that chapter is durable unless it expressly terminates on incapacity. This template still states durability expressly so your intent is clear on the face of the document.

When a durable POA takes effect

Durability answers what happens after incapacity. Effectiveness answers when the agent may start acting:

  • Immediate: authority begins when you sign (simplest for banks and agents)
  • Future date: authority begins on a date you choose
  • Springing / event-based: authority begins on incapacity or another stated event

Springing durable POAs can delay acceptance because third parties may demand proof that the trigger occurred. Immediate durable authority is often easier for institutions to rely on, even when the practical goal is incapacity planning.

A durable POA generally ends at death (or earlier revocation while you have capacity). It is not a will substitute and does not transfer property after death.

Powers you can grant

State rules to check before you sign

Power of attorney rules are set by your state. Many states borrow from the Uniform Power of Attorney Act, but the details differ: whether a POA is durable by default, what signing formalities apply, and how easily banks accept it.

You enter your state in the principal and agent details and the document adjusts. Two things worth confirming yourself: your state's signing requirements, and whether your bank has its own POA paperwork it prefers.

A few states publish their own official statutory form. California is one of them. If your bank insists on that exact form, use the state version rather than this one.

How to prepare your durable power of attorney

Name your agent and backups

Choose a primary agent you trust with money and paperwork, plus a successor if the primary cannot serve. Optional co-agents can act jointly or independently as you specify. Confirm each person is willing to serve and keep records.

Decide which powers to grant

Work through property and accounts, benefits and tax authority, and any hot powers that need clear wording. Keep durability in place while limiting scope if you only want help with specific assets.

Set when authority starts

Choose immediate effect, a future date, or an incapacity/event trigger. Immediate durable authority is usually simpler for banks. If you use a springing trigger, describe how incapacity will be shown (for example, physician certification) in special instructions when needed.

Execute with your state's formalities

Sign while you still have capacity. Many states expect notarization, witnesses, or both, and anything involving real estate usually needs to be notarized so it can be recorded. If your state requires its own official form, use that one. Give your agent a copy and keep the original somewhere safe.

Plan for revocation and review

You can usually revoke a durable POA in writing while you have capacity. Notify your agent and institutions that have a copy. Review after marriage, divorce, a move, new property, or a change in who should serve.
